2 07-07-2017 Heard the learned counsel for the petitioner.

The petitioner seeks regular bail in connection with Warisaliganj P.S. Case No. 75 of 2017, registered for the offence punishable under Sections 147, 148, 149, 341, 323 and 302 of the Indian Penal Code.

The case of the prosecution is that when the father of the informant was pegging bamboo for the purpose of cutting the Bargad tree, all the accused persons including the petitioner are said to have come there and started beating the father of the informant with lathi and bricks. It has been further alleged that initially upon direction given by co-accused Preman Yadav, one co-accused Raja Ram Yadav is said to have assaulted the father of the informant with iron rod on his head due to which he fell down

and thereafter, other accused persons including the petitioner are said to have assaulted the deceased with lathi and bricks.

The learned counsel for the petitioner submits that the allegation against the petitioner is general and omnibus in nature, specific allegation of assault by iron rod resulting in death of the deceased is against co-accused Raja Ram Yadav, the petitioner is old lady aged about 70 years, she has got clean antecedent and is in custody since 23.04.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Warisaliganj P.S. Case No. 75 of 2017.
