3 05-07-2017 Heard learned counsel for the petitioner and learned APP representing the State.

The petitioner seeks bail in connection with Kharagpur ( Shampur) P.S. Case No. 246 of 2016 registered for the offences punishable under Sections399, 402, 414 of the Indian Penal Code and Sections 25(1-B)A, 26(1) of the Arms Act.

Allegedly, Prince Kumar was apprehended and four persons succeeded in fleeing away and Prince Kumar stated the name of the petitioner and one Abhishek Kumar. From possession of Prince Kumar two country made katta and four cartridges were recovered. Prince Kumar stated that they have assembled to commit loot.

Submission is of false implication and that the petitioner has been implicated on the basis of confessional statement of coaccused made before the police which has got no evidentiary value

in the eye of law, the petitioner is suffering in custody since 01.02.2017 and as such he deserves sympathetic consideration.

Learned APP opposes the prayer of bail by submitting that the petitioner has confessed his guilt.

In the facts and circumstances stated above, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IVth, Munger in connection with Kharagpur P.S. Case No. 246 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
