3 04-07-2017 Heard learned counsel for the petitioners and learned APP representing the State.

The petitioners seek bail in connection with Alinagar P.S. Case No. 15 of 2017 registered for the offences punishable under Sections 302, 201, 120B of the Indian Penal Code.

Bhibha Devi, the daughter of the informant, was married to Umesh Yadav, the son of petitioner no. 1, and out of the wedlock there are one daughter aged about 11 years and one son aged about 9 years. The accused persons including the petitioners were demanding one she buffalo and for that they used to torture her and after getting information of the death of his daughter the informant went there and no one was present except his Nati and Natini who stated that all killed their mother and further they have cremated the dead body.

Submission is of false implication and that the statement of Sanjay Kumar Yadav, the son of the deceased, was recorded on separate sheet under Section 161 Cr.P.C. after paragraph 25 of the case diary wherein he stated that Dinesh Yadav and Amarnath Yadav assaulted with Mungri on the head of his mother causing her death. The petitioners have got no concern, they are old fatherin-law and cousin father-in-law and as such they deserve sympathetic consideration.

Learned APP submits that other witnesses have supported the allegation and the son of the deceased stated regarding the hands of co-accused Dinesh Yadav and Amarnath Yadav in killing of his mother.

In the facts and circumstances stated above, considering the statement of the son of the deceased, the petitioners above named are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Benipur in connection with Alinagar P.S. Case No. 15 of 2017, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two

consecutive dates on their part without any reason shall disentitle
