This appeal has been filed for grant of bail in connection with Pakaridayal P.S.Case No. 07 of 2017 registered for the offences punishable under Sections 302, 326, 307, 458, 120B of the Indian Penal Code, 27 of the Arms Act and 3(2)(v) A of SC/ST Act and for setting aside the order dated 18.4.2017 passed by Additional Sessions Judge-I-cum-Special Judge, East Champaran, Motihari.

Appellant is not named in the FIR and later on his name transpires in confessional statement of co-accused.

Submission of learned counsel for the appellant is that similarly situated co-accused have been granted bail in Cr.Appeal No. 1439 of 2017 and Cr.Appeal No. 1473 of 2017 and appellant is in custody since 20.2.2017.

Having heard both sides and in view of facts and circumstances of the case, the appeal is allowed and the impugned order is set aside.

Let the appellant, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-I-cum-Special Judge, SC/ST Act, East Champaran, Motihari, in connection with Pakaridayal P.S.Case No. 07 of 2017, subject to the conditions that :-

(i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) appellant shall co-operate in trial and appear in court on each and every date fixed and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
