JUSTICE RAKESH KUMAR ORAL ORDER 4 10-08-2016 Heard Sri Ratnakar Jha, learned counsel for the petitioner and learned AC to GP No. 3. Learned counsel for the petitioner submits that inadvertently the present petition was filed with a prayer to restore the earlier restoration petition i.e. MJC No. 1214 of 2016. He submits that the restoration petition stood dismissed not due to non -prosecution. Accordingly, he makes a prayer for withdrawal of the present petition so that he may file fresh restoration petition for restoring the main writ petition.
The prayer is allowed. This petition is disposed of with liberty to file fresh restoration petition for restoring main writ petition.
