It is contended on behalf of the petitioner that
Encroachment case no. 16/2013 has not been brought to its logical
conclusion till date though the respondent no.7 was noticed and
thereafter he has appeared in the matter and has admitted
encroachment by him
Having regard to the facts and circumstances, this writ application
is being disposed of, without going into the merit of the case, with
a direction to the Circle Officer Babubarhi, District- Madhubani to
bring the Encroachment case no.16/2013, which is with respect to
new khesra no. 459 is being claimed as rural (Government) road,
its logical conclusion within a period of two months from the date
of receipt/ production of a copy of this order after granting
Patna High Court CWJC No.5202 of 2015 (2) dt.13-01-2016
