JUSTICE CHAKRADHARI SHARAN SINGH) 8 27-06-2016 This application under Article 226 of the Constitution of India, in the nature of public interest litigation , has been filed by the petitioners seeking direction from this Court to make alternative arrangement for a Bus Stand at Mahua, after an agreement for running the Bus Stand at the land of one Dayanand Singh ( Respondent No.8) came to be cancelled.

From the pleadings on record, it transpires that since said Dayanand Singh, who was allowed to run the Bus Stand at Mahua under an agreement defaulted in making payment of the proceeds in terms of the agreement for running the Bus Stand, the same came to be cancelled.

Today a communication, dated 24.06.2016 of Joint Commissioner-cum-Secretary, Regional Transport Authority, Muzaffarpur, has been produced before us by learned counsel for the State, containing the minutes of the meeting of Regional Transport Authority, Muzffarpur, dated 09.05.2016, with regard to fixing the place of the Bus Stand and allotting the same in favour of Sri Manoj Kumar. From the said minutes, it appears that a decision has been taken to select a place of the Bus Stand which is to be run by one Manoj Kumar, who had applied pursuant to the advertisement in this regard.

So far the grievance of the petitioners, in the present writ petition is concerned, in view of the decision taken by the aforesaid communication, dated 24.06.2016, the same does not survive any further.

Certain issues have been raised on behalf of the petitioners as well as learned counsel representing the Respondent No.8 that the new location of Bus Stand is not convenient for the

general public of Mahua.

It goes without saying that the petitioners or the Respondent No.8 shall be at liberty to question the decision of the Regional Transport Authority, Muzaffarpur, to that effect in an appropriate proceeding, in accordance with law.

This application stands disposed of with the above observation.
