He seeks a direction on the respondent(s) to give him the benefit of the resolution of the Government contained in resolution no. 814 dated 17.10.2013

(Annexure-4). On going through Clause-4 (ii) thereof , prima facie, it appears the said resolution would not be applicable in the case of the petitioner. This is the stand of the respondents also in the counter affidavit.

Learned counsel for the petitioner seeks permission of the Court to ventilate his grievance before the appropriate authority of the respondent State for getting the benefit of the said resolution of the Government after relaxing the condition which disentitles him to get the benefit arising therefrom. There being no objection by the State respondent, the application is permitted to be withdrawn with liberty to the petitioner to ventilate his grievance before the appropriate/competent authority for consideration and disposal in accordance with law.
