In this case, petitioners were the members of Subordinate Education Service, are claiming that the Government has taken decision for merger with the Bihar Education Service (Class-II) w.e.f. 1^st January 1977 and the matter was challenged before this Court which was approved the merger and it was affirmed upto the Hon’ble Supreme Court. Claim has been made,

the same treatment should be given to the petitioners in view of the fact that these are the persons superannuated from service much earlier and on that account, this Court cannot entertain the present writ petition and the same is, accordingly, dismissed on account of delay and laches.
