The petitioner seeks bail in connection with Darpa P.S. Case No. 5 of 2009 registered for the offences punishable under Sections 147, 148, 149, 452, 342 of the Indian Penal Code, Section 17of C.L.A. Act and Sections 3 / 4 of Explosive Substance Act.

First Information Report is against unknown with allegation that 20-25 unknown miscreants tried to explode Narkatiaganj Bazar Exchange and after leaving banner and pamphlet fled away. During investigation name of the petitioner transpired and he remained absconding, resulting, chargesheet was submitted against him showing absconder.

petitioner was not aware that he is wanted in this case, he is suffering in custody since 21.09.2015, co-accused Munna Maiyan who was in custody since 23.06.2015 has already been allowed bail by learned court below vide B. P. No. 1760 of 2015, other coaccused Jagarnath Sah, Ramesh Ranjan, Shivpujan Rai, Ram Chandra Mahto and Rajendra Ram have already been allowed bail by different co-ordinate Benches of this Court and as such the petitioner also deserves sympathetic consideration to which learned APP opposes by submitting that the petitioner remained absconding and he has got criminal antecedent as he is involved in four more cases.

In the facts and circumstances stated above, considering the period of detention and further that other coaccused have been allowed bail, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Raxaul at Motihari, East Champran in connection with. Darpa P.S. Case No. 5 of 2009, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial

and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
