2 09-12-2016 Heard the counsel for the petitioner and Mr. Nityanand, APP for the State.

The petitioner prays for bail in Bochahan P.S. Case No. 126 of 2016 registered under sections 47/47(a) and other allied sections of the Bihar Excise (Amendment) Act, 2016.

On a search of the vehicle driven by the petitioner, 54 bottles of India-made foreign liquor, each containing one litre, were recovered.

The contention of the petitioner is that he is the first offender and is in custody since 13.08.2016. If granted the privilege of bail, he undertakes not to indulge in any such offence.

Considering the above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of ACJM-cum-Sub Judge-II, Muzaffarpur on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall remain in attendance in person on each date fixed at the trial. In case of default in doing so on two dates in a row, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
