A supplementary affidavit is filed.

The petitioner prays for bail in Jhajha P.S. Case No. 122 of 2016 registered under sections 399 and 402 and diverse penal provisions of the Arms Act.

On a tip-off, the S.I. of Police along with other police personnel(s) reached the place of occurrence and arrested seven accused persons including the petitioner. It is alleged that from the possession of the petitioner a country-made loaded pistol was recovered.

occurrence country-made pistols were recovered but they have now been released on bail by this Court. In this regard, counsel for the petitioner refers to diverse bail orders passed by this Court enclosed as Annexure-2 series. It is stated that the petitioner has no criminal background and is in custody since 04.07.2016.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction Sub Divisional Judicial Magistrate, Jamui in Jhajha P.S. Case No. 122 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
