The petitioners, namely, Riyaz Mian, Kitabul Mian, Adalat Mian, Hazrat Mian and Kalim apprehend their arrest in Katihar Muffasil P.S. Case No.133 of 2016 under Sections 341, 323, 504, 506, 353, 379/34 of the Indian Penal Code.
According to the prosecution case, when the informant party was measuring the land by the Amin, the petitioners protested and with intention to kill the informant, towel was put and neck was pressed. Thereafter, the accused persons snatched Rs.670/- from the pocket of the informant.

According to the learned counsel for the petitioners, the petitioners are next door neighbours of the informant. There is land dispute between the parties and, therefore, the petitioners have been falsely implicated in this case.
Considering the nature of allegation and the fact that the petitioners are next door neighbours of the informant, I direct the petitioners named above to surrender before the court below within one month from today and on their so surrendering, the court below is directed to release the petitioners on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Katihar Muffasil P.S. Case No.133 of 2016.
