3 29-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioners are not named in the first information report but in course of investigation, the name of these petitioners surfaced in this case and it is alleged that stolen carbine was recovered from possession of petitioners but submission on behalf of the petitioners is that the stolen carbine of the present case was recovered in Barauni (Gadhara) P.S. Case No. 176 of 2016 and the said recovery was made from possession of co-accused, Ravi

Kumar @ Lolwa and so far as petitioner no. 1 is concerned, only 500 gram ganja and K. Oil were recovered in the said case. Moreover, petitioners were made accused in the aforesaid Barauni (Gadhara) P.S. Case No. 176 of 2016 and both the petitioners have already been granted privilege of bail by a co-ordinate Bench of this Court in Barauni (Gadhara) P.S. Case No. 176 of 2016. To fortify the aforesaid contention, learned counsel for the petitioners drew my attention towards Annexure-2/1 as well as Annexure-4 to the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 17 of 2015.
