Petitioner seeks bail in a case registered under section 47 (a) of the Excise Act as well as section 137 of the Railway Act.
23 bottles containing near about 13 liters Indian made foreign liquor are said to have been recovered from the conscious possession of the petitioner while petitioner was found travelling in a train.
Submission on behalf of the petitioner is that one co– accused Raju Kumar @ Mithun Kumar, having more or less similar allegation, has already been granted privilege of bail by a coordinate bench of this court vide order dated 16.8.2016 passed in Cr. Misc. no. 32059/2016.
Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like
