The petitioners seek quashing of the order dated 7.5.2010 passed by the Judicial Magistrate, Muzaffarpur in Complaint Case No. C2807 of 2010.

The case of the complainant is that he was transacting the business with the petitioners and had paid huge money for the goods which has not been supplied.

Having gone through the records of the case I am unable to convince myself as to how a criminal offence is made out in the facts of the case. Hence the application is allowed and order dated
