This application for grant of anticipatory bail arises out of C.A. Case no. 853 of 2011, disclosing offences under sections 406 and 420 of the Indian Penal Code and section 138 of the N. I. Act.

Upon perusal of the complaint petition and the assertions made in the present case seeking anticipatory bail, it transpires that earlier cognizance was taken for different offences but subsequently by order dated 11.12.2014 cognizance under sections 406 and 420 of the Indian Penal Code and Section 138 of the N. I. Act was taken giving cause of action to the petitioner to approach this Court seeking anticipatory bail.

Upon considering the submissions advanced at the

Bar and the statements made in the application seeking anticipatory bail, I am convinced that it is purely a civil dispute between the parties for which money suits have been filed by them.

Considering the above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Shri A. K. Rai, Judicial Magistrate, 1^st Class, Patna City in connection with C.A. Case No. 853 of 2011, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.

This is subject to the condition that the petitioner shall present himself before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
