The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,324,379,504,506 and 384 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that on 18.11.2012 the informant along with his friends were returning home from Punjab on the even of Chhath Pooja festival when the accused persons abused by calling the caste name and demanded two thousand rupees as extortion. On protest being made the accused assaulted the informant side and snatched five thousand rupees.

It is submitted by the learned counsel for the petitioners that for the occurrence of 18.11.2012 the FIR was registered on 20.11.2012. The petitioners side lodged Sour Bazar (Baijnathpur OP) P.S. Case No. 443 of 2012 on 19.11.2012 with accusation under sections 147,148,149,324,307,504 and 506 IPC and section 27 of the Arms Act against the petitioner side. It is further submitted that the accusation is omnibus and general.

It is submitted by Mr. Ambika Bhagat, learned Special APP that on conclusion of investigation charge sheet has been submitted.

Considering the case lodged by the petitioners side at earlier point of time, the accusation being omnibus and general and the petitioners having no criminal antecedent, it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Sour Bazar (Baijnathpur OP)
