Case No. 215 of 2008 registered under sections 364, 448, 504, 506/34 of the Indian Penal Code. And 27 of the Arms Act. The informant named 16 persons and alleged that on 19.05.2008 all the accused persons kidnapped the brother of the informant. Learned counsel for the petitioners submits that the occurrence is of 19.05.2008 but the first information report was lodged on 20.07.2008. For two months the informant did not give information about the missing of his brother Bablu Mahaldar.

The informant is not eye witness of the occurrence. On mere suspicion the police submitted charge sheet. It appears that the informant has himself stated in his fardbeyan dated 20.07.2008 that on 19.05.2008 the 16 accused persons named therein kidnapped his brother.

Considering the aforesaid facts , the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M. Bhagalpur in Pirpainti P.S. Case No. 215 of 2008
