Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that informant Saroj Devi alleged that on 7.8.2014 at about 7.30 P.M. petitioners along with 4-5 unknown miscreants started abusing by caste name and asked to demolish the boundary wall and threatened for dire consequence. She claims to identify the unknown persons also.

It is submitted on behalf of the petitioners that except offence under SC/ST Act, all other sections are bailable. Further it

has been submitted that offence under SC/ST Act is not attributed in the present case as the place of occurrence is not in public view.

On behalf of the State, it has been submitted that the petitioner is named in the FIR and there is specific allegation against the petitioners.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Rahul Kumar, learned Judicial Magistrate, 1^st Class, Nawadah in connection with Nawadah Town SC/ST P.S.Case No. 42/2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
