The prosecution story, in brief, is that the petitioner is named in the F.I.R. as the accused who along with other accused persons allegedly indulged into altercation and thereafter scuffle on the question of making protest, when he asked the informant and his colleagues to take away the motorcycle parked there. The allegation is that in such altercation, these petitioners indulged into assault with lathi, danda and also snatched I. Card and cash amount. petitioners thus, interrupted the informant and his colleagues from performing their duties.
It is submitted on behalf of the petitioner that the main allegation is against one Shambhu Yadav. There is no specific allegation against the petitioner. Nothing incriminating has been recovered from the possession of the petitioner. The occurrence is said to have taken place due to parking of motorcycle, which resulted into hot exchange of words between both the parties.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Mufassil P.S. Case No. 501 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
