3. 04-03-2015 Heard learned counsel for the petitioner and Sri Harendra Prasad, learned Addl. Public Prosecutor.
The petitioner, who is in custody since 10-07-2013 in Dumariyaghat P.S. Case No. 86 of 2013 registered for the offence under Sections 25(1-b)a, 26, 35 of the Arms Act, 1959, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that other two accused persons, namely; Pappu Kumar and Rakesh Kumar were already granted bail by this Court on 25-04-2014, vide Cr. Misc. No. 10589 of 2014.
Learned Addl. Public Prosecutor opposes the prayer of bail. He submits that one loaded country-made pistol was recovered from the possession of the petitioner.

Keeping in view the fact that some other accused persons have already been granted bail and the petitioner is in custody since 10-07-2013, let the petitioner namely Naveen Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Motihari, in connection with Dumariyaghat P.S. Case No. 86 of 2013.
