JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 04-02-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State. The petitioner is accused in connection with Mithanpura P.S. Case No. 184 of 2014 registered under Sections 363/34, 363A, 368 and 120B of the Indian Penal Code.
The accusation of informant is that his son Ayush in the morning on 22.06.2014 was found missing. In course of search, Saket Paswan of his Mohalla informed that Naresh Paswan carried his son on tempo towards Mithanpura, when the informant approached at the house of Naresh Paswan, he found absent and he came to know that petitioner was seen prior to the occurrence near the place of occurrence along with his son.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the

name of the petitioner has been disclosed on mere suspicion. Moreover, the victim Ayush, son of the informant is said to be recovered in course of investigation at the house of Laylal Rai on the basis of information of co-accused Naresh Paswan. It is also submitted that petitioner has no criminal antecedent and is in custody since 24.06.2014.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., East, Muzaffarpur in connection with Mithanpura P.S. Case No. 184 of 2014 corresponding to G.R. No. 3114 of 2014.
