The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
The prosecution case is that the mother of the informant went outside to ease and thereafter she did not return. On next day the dead body of the mother of the informant was recovered. It is suspected that the mother of the informant was killed by the hands of the accused persons due to enmity.
It is submitted by learned counsel for the petitioners that the petitioner is agnate of the informant and due to the enmity the petitioner has been roped in the present case.

A statement has been made in paragraph 3
of the petition that the petitioner has no criminal antecedent.
It is submitted by learned counsel for the informant that prayer for anticipatory bail of similarly situated co-accused Dinesh Manjhi and Manish Manjhi has been rejected vide Cr. Misc. No. 35296 of 2014.
Considering the suspicious nature of accusation, it is a case for consideration of prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Banka P.S. Case No. 46 of 2014 pending in the court of learned Chief Judicial Magistrate, Banka.
With the aforesaid observation, this
application is disposed of.
