Learned counsel for the petitioner submits that there is absolutely no evidence against the petitioner. The petitioner is neither named in the first information report nor any incriminating article was recovered from possession of the petitioner. The petitioner was apprehended by the police on mere suspicion and his confessional statement is said to have been

recorded, although the petitioner denied to have made any confessional statement before the police. Ramdeo Mandal, driver of the vehicle has already been enlarged on bail by the trial court. The police during the course of investigation did not collect any admissible evidence except the confessional statement of the petitioner before the police to show involvement of the petitioner.

Considering the facts and circumstances stated above, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Hirdai Narayan Pandey, learned Additional Sessions Judge IV, Munger in connection with Session Trial No. 859 of 2014 arising out of Asarganj P.S. case No. 43 of 2014.
