JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 2 23-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, he was arrested and allegedly, rupees one lac looted amount was recovered from his conscious possession. Petitioner confessed his guilt and accordingly, he was put on trial. In course of trial, one prosecution witness claimed to have identified him but the aforesaid witness admitted that petitioner was well known to him prior to the alleged occurrence as petitioner was engaged in the business of selling the buffalo and ox. So far as recovered amount is concerned, it is submitted on behalf of the petitioner that the aforesaid amount was of petitioner and not of looted money.
