2 12-10-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Katihar Town (Sahayak) P. S. Case No. 206 of 2015 registered under Sections 147, 148, 149, 323, 341, 420, 465, 468, 120-B of the Indian Penal Code.

It is contended that initially a complaint was filed which was referred to police under Section 156 (3) of the Code of

Criminal Procedure for investigation in pursuant to which the instant FIR was instituted. It is further contended that from bare perusal of the prosecution case, it would appear that no fraud has been done by the petitioners. As a matter of fact, petitioners no. 2 and 3 have executed their own share of land in favour of petitioner no. 4 and a patently false case has been instituted. It has further been contended that petitioners no. 5 to 7 are identifiers and witnesses to the sale deed in question.

Learned counsel for the State has opposed the prayer for

bail.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in Katihar Town (Sahayak) P. S. Case No. 206 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
