The petitioner has preferred the present application for grant of anticipatory bail in a case registered for the offences punishable under Section 363 of the Indian Penal Code.

The offence under section 363 IPC is bailable, hence the anticipatory bail of the petitioner was neither maintainable before the learned Sessions Judge nor it is maintainable before this court.

Accordingly, this application is disposed of with a liberty to the petitioner to surrender and pray for regular bail in connection with Kharagpur P.S. Case No. 83
