Learned Additional Sessions Judge-I, Madhepura has referred several paragraphs of the case copy in the impugned order but from perusal of the case diary, I find that in several paragraphs of the case diary, several witnesses stated that coaccused, Vijay Kumar replaced the sub standard bricks and also returned some amount to victims.

Sessions Judge-I, Madhepura even did not take pain to go through the relevant paragraphs of case diary. Moreover, co-accused Vijay Kumar has already been admitted to privilege of anticipatory bail by this court whereas; the petitioner is languishing in jail custody since 11-10-2014.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Singheshwar P.S. Case No. 06 of 2011 to the satisfaction of Chief Judicial Magistrate, Madhepura.
