JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 3 16-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Although petitioner is named with allegation that he along with others, assaulted the deceased with fist and slaps and he as well as other accused, having stood on the chest of the deceased, twisted over on the chest and abdomen, as a result of which, the deceased died. It would appear from perusal of paragraph-6 of the case diary, that it was co-accused, Nagmani, who having stood on the abdomen of the deceased, twisted over on the chest and abdomen, as a result of which, deceased died.
