JUSTICE SUDHIR SINGH ORAL ORDER 3 09-09-2015 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is apprehending his arrest in connection with R.PF. Ara Case No. 614/2013 for the offences instituted under Section 160(B) of the Railway Act. The prosecution story, in brief, is that the petitioner being the driver of the bus dashed the boom of railway gate and broken the boom of such railway gate and fled away. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused in the present case due to mistake of fact.
