According to prosecution case itself, the alleged rape was committed in the year, 2012 but the present case was lodged in the year, 2015. Moreover, it has also been alleged in the first information report that after the above-said incident of rape, the petitioner, forcibly, solemnized his marriage with the victim in a temple and thereafter, started blackmailing the victim.
Learned counsel for the petitioner submits that as a matter of fact, the victim is legally wedded wife of the petitioner

and the petitioner has filed a suit for restitution of his conjugal right in the court of Principal Judge, Family Court, Khagaria.
Learned counsel, appearing for the informant submits that the allegation, levelled against the petitioner itself speaks voluminous about the ill deeds of the petitioner.
Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/(ten thousand) with two sureties of the like amount each in connection with Gogri P.S. Case No. 81 of 2014 to the satisfaction of Sri Ankur Gupta, learned Judicial Magistrate-Ist Class, Khagaria.
