The petitioner is, of course, named in the F.I.R. along with other accused persons, but Santosh Chaudhary, the informant, alleged that some days prior to the occurrence, the petitioner and others had threatened his brother not to work in the brick kiln.
It appears that the informant is not an eye witness of the occurrence. Even during the course of investigation, except suspicion, no tangible evidence has been collected against the petitioner.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like
