2 29-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case

registered for the offences punishable under Sections 147,323,504 and 379 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the accused persons came variously armed at the door of the informant, abused by calling the caste name, made assault and took away Rs.1100/- from the pocket of Sanjay Paswan. A supplementary affidavit has been filed to the

effect that there is no injury caused to the informant side. It is submitted by the learned counsel for the petitioners that on the same date the petitioner no.2 side lodged Saraiya P.S. Case No. 175 of 2014 against the informant side. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. More over, the occurrence took place on the door of the informant which cannot be treated to be a place of public view.

Considering the accusation in the background of litigated relationship between the parties from before and the petitioners’ side lodged case against the informant side, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Muzaffarpur in connection with Saraiya P.S. Case No. 174 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
