JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 28-04-2015 Petitioner is languishing in custody since 28.08.2013 in a case registered for the offences punishable under Sections 363, 364(A)/34 of the Indian Penal Code. The informant’s son Monu Kumar went missing with his auto rickshaw on 26.08.2013. Subsequently the informant came to know that he was being kidnapped by 5- 6 miscreants on Bolero vehicle. The petitioner was arrested from the place of recovery of the victim.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C statement the victim has not named this petitioner whereas Sunil Rai and Uday Rai who have been named by the victim in his 164 Cr.P.C statement have been granted bail vide Cr. Misc. No. 45461 of 2014 and Cr. Misc. No. 42532 of 2014.

Considering the aforesaid facts, let the

petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 4^th Additional Sessions Judge, Muzaffarpur in connection with Aurai P.S. Case No. 156 of 2013.

Since the petitioner is accused in two other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner gets substantially involved in similar nature of offence or defaults for three consecutive occasions during trial.
