Mr. Ashok Kumar Choudhary, learned counsel appearing on behalf of the District Magistrate, Muzaffarpur, has submitted that since there was a perfunctory enquiry report submitted by the earlier Enquiry Officer, the District Magistrate could not have concluded the departmental proceeding on the basis of such perfunctory enquiry report and therefore, he has now appointed Addl. Collector as new Enquiry Officer to enquire the allegations against the petitioner de novo.

Considering the fact that the petitioner faces very serious allegation of accepting illegal gratification, this Court would, though reluctantly, grant four months time to conclude the departmental proceeding against the petitioner and it is made clear

that if the departmental proceeding against the petitioner is not concluded in the aforementioned period of four months from the date of receipt of this order, the District Magistrate, Muzaffarpur shall be held personally liable for committing contempt of the earlier order as well as this order of this Court.
