2 15-07-2014 Heard learned counsel for the petitioner and Mrs. Renuka Sharma, learned counsel appearing for B.S.N.L.

The prayer of the petitioner in this writ application reads as follows:

“(i) For issuance of a writ in the nature of mandamus or any other appropriate writ/ writs, direction commanding the respondents to make payment of admissible dues of the petitioner i.e. Rs.8,16,189.93 which is due upon them against the fuel., HSD and lubricants supplied to the respondents by the petitioner.

(ii) For issuance of a writ in the nature of mandamus directing the respondents to make payment of interest

@ 18% per annum on the said amount till the actual date of payment.”

Learned counsel for the petitioner has relied on an order of this Court dated 9.5.2014 in C.W.J.C.No. 19116/2013, whereby and whereunder a similar writ application having exactly the same grievance has already been disposed of by directing the General Manager, B.S.N.L. to consider and dispose of the claim of that petitioner within a period of two months.

Mrs. Sharma submits that the case of the petitioner shall also be considered within a period of two months from the date of receipt of this order.

That being so, this application is disposed of with a direction to respondent no.2, General Manager, BSNL to consider and dispose of the claim of the petitioner within a period of two months from the date of receipt of this order and it is also made clear that whatever amount is found due and payable to the petitioner the same should also be paid to him within a further period of two months thereafter. If any part or whole of the claim of the petitioner is rejected, reasons for the same must be communicated to the petitioner within the same period of two months.
