4 03-01-2014 There is no dispute between the parties especially in the stand taken by the State that in identical situation yet another petitioner namely Maheshwari Devi had approached this High Court in a writ application wherein in the same transaction even she was removed or dismissed from the post of Anganwari Sevika for the reasons indicated in the said order. The Court found the decision or action as vulnerable in law and set aside such a decision. However, liberty was given to the authorities to proceed in accordance with law.

Since the removal of these two petitioners is in identical situation, which has been talked about in the order contained in Annexure-8, even this writ application stands allowed. The impugned order dated 28.9.2012, contained in Annexure-5, is quashed.
