promotion. No doubt, initially when the order of suspension was challenged and on the interim order LPA No. 1523 of 2009 was filed and is pending; but taking into consideration the fact that the suspension now stands revoked, the legal proceedings virtually have become infructuous for all practical process. Independent of that, if the ACR of the petitioner has now been completed for that period and is available with the respondent authorities then the claim of the petitioner for consideration for grant of promotion in the cadre of I.A.S. will be considered on its own merit provided the petitioner fulfils all other requirements for such selection.

If for any reason, the ACR for that period is not made available to the authorities, it should be done so without any delay so that that does not become a reason for non-consideration of the petitioner’s case by the concerned committee.

The writ application stands disposed of with the above observations.
