7 05-12-2014 In what seemed to be an issue involving title over the land in question, has turned out to be a numerical jugglery of the plots in question by the petitioner.

The petitioner has filed this writ petition questioning the initiation of proceedings under the provisions of the Bihar Public Land Encroachment Act, 1956 (hereinafter referred to as ‘the Act’) in Encroachment Case No.1 of 2013-14, inter alia, on grounds that it related to his khatiyani plots 99 and 100 situated at village- Kothi in the district of Gaya. In support of his

contention the petitioner has relied upon a khatiyan placed at Annexure-1 to the writ petition and with reference to the first notice issued by the Circle Officer as a Collector under ‘the Act’ it was submitted that it related to plot no.90 which was not relatable to the petitioner and which notice was followed by a subsequent notice issued on 19.10.2013 placed at Annexure-3 whereunder the petitioner was charged for encroachment over plot nos.90 to the extent of 0.05 decimals, plot no.99 to the extent of 0.15 decimals and plot no.100 to the extent of 0.02 decimals. It is the case of the petitioner that the notices were followed by a notice under section 6(2) of ‘the Act’ requiring the petitioner to remove the encroachments so set out in the earlier notices failing which proceedings under section 188 of the Indian Penal Code would be initiated. This notice was followed by an order bearing Memo No.802 dated 11.12.2013 with a direction to the Circle Inspector to remain present on 19.12.2013 for removal of encroachment allegedly done by the petitioner. The petitioner being aggrieved represented before the District Magistrate –cum- Collector on 26.12.2013 and the Collector directed the Circle Officer to get the measurement done as to the extent of encroachment and to inform him accordingly. Since no steps were taken by the Circle Officer in this regard that the writ petition was filed.

I have heard Mr. Vinod Shankar Modi, learned counsel appearing on behalf of the petitioner, Mr. Anshuman Singh, learned Government Pleader No.24 for the State and Mr. Shashi Shekhar Dwivedi, learned senior counsel appearing for the interveners, who were applicants in the encroachment case. An interlocutory application bearing I.A. No.7882 of 2014 filed on behalf of the interveners has been allowed vide order passed on 1.12.2014 and as a consequence these interveners have been added as respondent nos.7 and 8 to the writ petition.

It is the contention advanced on behalf of the petitioner by Mr. Modi that since the petitioner was a khatiyani raiyat of plot nos.99 and 100 to the extent of 0.23 decimals and 0.12 decimals respectively there would be no occasion for the respondent for initiating encroachment proceeding and that the notices relatable to those plots are patently illegal. He with reference to the khatiyan placed at Annexure-1 has submitted that it clearly demonstrates that there is a house standing thereon and which is existing since last 50 years. It was thus the contention of learned counsel that the dispute being civil in nature, the respondents could not resort summary proceeding rather their remedy lies elsewhere.

The arguments of Mr. Modi has been vehemently contested by Mr. Singh as well as Mr. Dwivedi appearing for the

State and the private respondents respectively and it was contended that the petitioner had not placed the correct facts before this Court. Whereas it is a clear stand taken by the learned State Counsel that the encroachment proceeding in no manner touches the raiyati land of the petitioner, it was the argument of Mr. Dwivedi that the number of the plots referred to in the khatiyan placed at Annexure-1 is the number of plots as it existed at the time of cadastral survey. It was submitted by Mr. Dwivedi that following the cadastral survey a revisional survey took place subsequently which again was followed by consolidation operations and whereunder plot nos.99 and 100 in the cadastral survey stand renumbered as chak plot nos.96 and 97 and the number of plots mentioned in the notice issued by the Circle Officer under ‘the Act’, is the number of plots as reflecting in the Chakbandi khatiyan. He thus submitted that these plot nos.99 and 100 as occurring in the notice issued under ‘the Act’ are not the same plot as reflected in the cadastral survey khatiyan placed at Annexure-1 and thus the petitioner had not placed the correct fact before this Court.

To support his contention Mr. Dwivedi has referred to the very representation of the petitioner present at Annexure-6 dated 26.12.2013 in which the petitioner has admitted that his cadastral survey plot nos.99 and 100 have been renumbered as

chak plot nos.96 and 97. This very sentence of the petitioner himself, is luminescent of the fact that the entire argument of Mr. Modi based upon the cadastral survey khatiyan was misdirected. The plots claimed by the petitioner as occurring in the cadastral survey khatiyan bearing nos.99 and 100 as per his own admission was renumbered as chakbandi plot nos.96 and 97 and the encroachment proceedings have been initiated for removal of encroachment from chak plot nos.90, 99 and 100 and not Chakbani Plot Nos.96 and 97. It is thus manifest that the raiyati land of the petitioner is not the subject matter of the proceedings rather it is the encroachment made by the petitioner over the Government land bearing Chakbani Plot Nos.90, 99 and 100 which is the subject-matter of encroachment proceeding and since the plot numbers have not been clarified to read chak plots that the petitioner has sought to draw advantage therefrom.

In view of the circumstances reflecting, no cause for interference is made out.

This writ petition is dismissed.
