The main grievance whatever petitioner has, who happens to be an informant of Raxaul Railway P. S. Case No. 012/2012, is that the police is not conducting the investigation in impartial manner and on account thereof, prayed for directing the Investigating Officer to do impartial investigation without being influenced at any corner.

At the other hand, learned A.C. to A.A.G. submitted that after concluding the investigation, charge sheet had already been submitted against co-accused Dhrub Sah while investigation has been kept opened for remaining because of non apprehension of the remaining accused.

After hearing rival contentions as well as going through the respective pleadings, it is apparent that the petitioner, who happens to be an informant of Raxaul Railway P. S. Case No. 12/2012, has subsequently been transposed as an accused during course of investigation along with the witnesses, so cited on his behalf and out of them, for the present, charge sheet has been submitted against Dhrub Sah.

It has been submitted on behalf of State that the police, who is the Investigating Officer, is going to submit charge sheet against all the culprits, who have been identified during course of investigation. Therefore, it has been submitted that investigation has already been concluded to its logical end.

However, it is made clear that petitioner, being an informant, will have other options available in accordance with law if he found so aggrieved by the conclusion of the Investigating Authority.

With the aforesaid observation, the instant petition is disposed of.
