The petitioner seeks bail in a case which has been registered under Sections 498A, 302, 201/34 of the Indian Penal Code against the petitioner and other persons. The informant’s daughter Sajida Khatoon was married 12 years back with the petitioner. After she died when it was claimed that she has been killed by the petitioner and another. Submission is that the informant has lodged the case in hurry and when he ascertained about the real fact they filed the petition before the court below on account of wrong informant he has filed a wrong case. The Police after investigation found the case under Sections 302 of the Indian Penal Code rather under

Section 306 of the Indian Penal Code. No other witness has supported the allegation of demand of dowry.

Considering the facts and circumstances of the case,

let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. / court concerned, Birpur (Supaul) in connection with Birpur P.S. Case No. 223 of 2013.
