The petitioner seeks bail in a case which has been registered against unknown five dacoits under Section 396 of the Indian Penal Code. Allegation is that the dacoits had looted the articles and have killed.

Submission is that the petitioner is not named in the FIR has not been put on test identification parade and identically situated accused Md. Abdul @ Hamidul on 26.11.2013 in Cr. Misc. No. 23029 of 2013 and Md. Rabbul @ Rabbul on 20.3.2014 in Cr. Misc. No. 4961 of 2014 have been granted bail by this

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Additional Sessions Judge-I/court concerned, Katihar in connection with Sessions Trial No. 141 of 2014, arising out of Barsoi (Kachna) P.S. Case No. 191 of 2012.
