The petitioners apprehending their arrest in connection with Kanti P.S. Case No. 186 of 2013 instituted under diverse sections of the Penal Code including section 302 I.P.C. have prayed for anticipatory bail.

In respect of the occurrence which had taken place on 03.06.2013 an F.I.R. was lodged alleging therein that co-accused Md. Mukim, Md. Saddam, Md. Biku, Md. Jahangir & Md. Sonu assaulted the informant and his brother by iron rod when they had gone to the house of the accused persons. Further allegation is that co-accused Md. Mukim stabbed the father of the informant causing grievous injury. The said injury later proved fatal.

Learned counsel for the petitioners submits that informant of the present case is husband of petitioner no. 1.

In respect of the occurrence which had taken place on 03.06.2013, another F.I.R. was lodged by the petitioner no. 1 alleging therein that her husband and others had intruded into the house and assaulted her with iron rod causing grievous injuries on forehead and other parts of her body inasmuch as she was admitted to Hospital. It is next contended that even going by the allegation contained in the F.I.R., no overact has been assigned to the petitioners herein.

Having heard the parties and considering the allegations contained in the F.I.R., this Court directs that let the petitioners namely, Sajra Khatoon & Rubaida Khatoon, in the event of their arrest or surrender within a period of three weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Kanti P.S. Case No. 186 of 2013 subject to the condition that one of the bailors would be own/close family member of the petitioner and other conditions contemplated under section 438(2) of the Code of Criminal Procedure.
