The petitioners seek bail in a case which was registered under Sections 147, 148, 149, 341, 342, 323, 324, 325, 326, 307, 302, 427, 380, 109 & 120(B) of the Indian Penal Code. Two persons were killed by a mob consisting of the petitioners and others. Altogether 40 persons have been named as accused. It has been alleged that a big mob consisting of the petitioners and others came and committed various overt acts which led to the death of two persons.

situation many accused persons have been admitted to bail. From Annexure 3, it is apparent that 12 persons were granted bail. The case of the petitioners is similar to those who have been admitted to bail.
Prayer for bail has been opposed by the informant.
Considering the facts and circumstances of the case, the petitioners, namely, Md. Tahir and Md. Bakar are directed to be released on bail on their furnishing bond in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case No. 39/2013 (G.R. No. 285/2013).
