The petitioners seek bail in a case which has been registered for offence under Section 341, 323, 353, 427, 504 and 506/34 of the Indian Penal Code.

A boy aged one and half years was admitted, he was provided treatment but he died. The informant is the doctor and he has alleged that he was threatened by the accused persons. Submission is that the petitioners were not present at the place of occurrence and they have no relationship with the father of the victim-child. No case under Section 353 of the Indian Penal Code is made out and the petitioners are men of clean past.

Considering the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in Kotwali P.S.Case No. 296 of 2013.
