3 01-07-2014 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 323, 307, 504, 279, 338, 337, 406, 34 of the Indian Penal Code registered in connection with Shambhuganj P.S. Case No. 111 of 2013.

Accusation is that the following a minor collision involving the petitioner’s Motorcycle and the complainant’s Cycle there was an altercation in which the petitioner no. 1 injured the complainant in his left eye with his Motorcycle key.

It is submitted that the complaint has been filed

20 days after the alleged occurrence. The alleged occurrence is attributable to the petitioners act in the heat of the moment. The petitioners claim clean antecedent.

Considering the above facts, as such, in the event of the petitioners’ arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Shambhuganj P.S. Case No. 111 of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C. With additional condition that the petitioners will be well represented on each and every date and if they fails to do so on two consecutive dates, their bail bonds will be liable to be cancelled by the Court concerned.
