The petitioner seeks bail in connection with Hajipur Town P.S. Case No.429 of 2013 registered under Sections 147, 302 and 120(B) of the Indian Penal Code besides Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the informant is not an eye witness to the occurrence. The petitioner and six others have been made accused by the informant on mere suspicion. It is further submitted that the petitioner having no criminal antecedent is in custody since 15.7.2013 and similarly situated co-accused, namely, Basant Kumar Singh, has already been granted bail by a Bench of this Court vide order dated 20.3.2014 passed in Criminal Misc. No.48785 of 2013.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S. Case No.429 of 2013.
