3	28-03-2014 Heard learned counsel for the petitioners and the learned A.P.P. for the State. Both applications are related to Sadar (Purnea) P.S. Case No. 311 of 2013 registered under Section 302 of the Indian
	Penal Code and Section 27 of the Arms Act, hence both applications are heard together and are being disposed of by common order.
	The allegation is that Ram Krishna Pal, husband of informant, Jharna Pal, was killed by unknown miscreants through firearms, in course of returning to his house from his shop. The cause of murder is said to be the land dispute.

Learned counsel for the petitioners submits that petitioners are not named in the F.I.R. rather their names have come mere on suspicion as there was an agreement to sale the land in between the deceased and the petitioner, Awadh Kishore Sahni, but the land in question was in dispute so the deceased asked to returned the Rs. 5 lacs as given in advance but he was ready to return half of the amount due to that reason deceased had also lodged the case, i.e., C.A. No. 244 of 2013. It is further submitted that petitioner Sikandar Prasad Yadav @ Sikandar Yadav was said to be the witness of the said agreement to sale except that there is nothing against the petitioners. The petitioner, Sikandar Prasad Yadav @ Sikandar Yadav and petitioner, Awadh Kishore Sahni are in custody since 08.08.2013 and 18.09.2013.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with Sadar (Purnea) P.S. Case No. 311 of 2013.
