Rumadu Devi @ Ramdhu Devi and Bunna Soren seek bail in complaint case no.565 of 2002 under Sections 419,420 and 120B of the IPC. Learned counsel for the petitioners submits that petitioners are legally wedded wife and son of late Khara Soren who was working in Indian Railway and after his death the petitioners got retiral benefit.

On the other hand, the learned counsel for the complainant submitted that the complaint petition is of the year 2002 and the complainant is the legally wedded wife of late Khara Soren. She got maintenance from her husband and therefore the

petitioners played fraud in withdrawing the retiral benefit from the department.

It appears that there is a dispute between the complainant and the petitioner no.1 and both of them claimed to be the legally wedded wife of late Khara Soren. The Department made payment after verification of documents. The petitioners are in custody since 24.07.2014.

Considering the facts and nature of allegation against the petitioners, let the petitioners, namely, Rumdu Devi @ Rumda Devi @ Smt. Rumadu Devi @ Ramdhu Devi and Bunna Soren be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Ist Class, Katihar in Complaint Case No.565 of 2002.
